BURNING HOURS FOR CLARK BOROUGH-6:00AM TO 8:AM AND 4:00PM TO 9:00PM
BURNING ORDINANCE
SECTION 1
Unlawful to burn substance causing Noxious Odors. It shall be unlawful for any persons to burn upon any premises,lot,street,alley, public place within the limits of the Borough of Clark any material or substance causing noxious or offensive odors at any time of the day or night.
SECTION 2
Fires unlawful certain times;Permit required for certain fires.
It shall be unlawful for any person or persons to burn or to permit to remain burning upon any, lot, street, alley, or public place within the limits of the Borough of Clark any loose, dry papers or dry combustible materials of non-noxious nature at any time during the day or night, except between the hours of 6:00 am and 8:00 am and the hours of 4:00 pm and 9:00 pm, during which hours burning of the same may be allowed in residential zones only to accommodate the burning of normal and reasonable household accumulations. All other fires, including but not limited to all fires in business districts and fires following construction and reconstruction, shall be not only confined to the hours stated, but in addition, shall not take place unless a prior permit for the same shall have been issued by the Borough Fire Department, which permit shall be issued by order of the Fire Chief of other persons authorized by him.
SECTION 3
Restrictions
The right to burn combustible materials of non-noxious nature during the hours set forth in section 2 of this ordinance shall be subject to the further conditions that:
1. No fire shall be let to burn within 10 feet of any building or structure.
2. No fire shall be permitted to burn unattended.
Section 4
Penalty for violation
Any person, firm or corporation violating any provision of this ordinance shall, upon conviction thereof in summary proceedings, [shall ] be sentenced to pay a fine of not less than $5.00 and not more than $100.00, to be collected as other fines are collected by law, and in case of default of payment, to undergo imprisonment in the county jail for a period not to exceed 30 days.
Section 5
Exception for brush fires
The provisions of this ordinance shall not apply to the burning of brush, grass or weeds with in the limits of the Borough, provided that such burning is done with prior notice to the Borough Fire Department and with the permission and supervision of the same.
